The Canada Border Services Agency (CBSA) announced that it needed more time for making preliminary determinations with respect to the investigation into the alleged injurious dumping of certain hot-rolled carbon steel heavy plate and high-strength low-alloy steel heavy plate from Chinese Taipei, Germany, South Korea, Malaysia, and Turkey.

The Special Import Measures Act (SIMA) provides that, under normal circumstances, the preliminary stage of the investigation shall be completed within 90 days of the date of initiation.

However, due to the existence of circumstances that, in the opinion of the CBSA, make it unusually difficult to decide within ninety days whether to make a preliminary determination of dumping or to terminate the investigation with respect to some or all of the goods, the period has been extended to 135 days, pursuant to subsection 39(1) of SIMA.

Consequently, the decision to issue a preliminary determination of dumping or to terminate the investigation with respect to some or all of the goods will be made on or before October 9, 2020.

The Canadian International Trade Tribunal issued a preliminary decision in July, saying it found a reasonable indication that the dumping of the steel plate from the five countries have caused injury or is threatening to cause injury to Canadian industry.

The CBSA's current investigation will determine, if applicable, the margins of dumping for the goods in question.
